2. Contractor responsibilities
Where Roofing Goats is the contracting party, Roofing Goats is responsible for:

Where Goat Home Services Pty Ltd trading as Roofing Goats is identified as the contractor, Roofing Goats remains the customer's contracting party even where parts of the works are performed by employees, subcontractors, specialist tradespeople or suppliers engaged for the project.
The engagement of a subcontractor does not alter the customer's payment obligations or contractual relationship unless otherwise agreed in writing.
4. Quotations and estimates
Any quotation, proposal, estimate, or scope issued by Roofing Goats is based on the information available at the time, including site photos, inspections, customer information, visible roof condition, access, measurements and contractor input. Quotes may change where further inspection or commencement of works reveals additional issues, including but not limited to:
- rotten timber;
- structural defects;
- unsafe access;
- asbestos or hazardous materials;
- non-compliant existing works;
- hidden water damage;
- damaged battens, rafters, fascia, gutters, flashings or valleys;

- weather damage;
- changes requested by the customer.
Any material change to scope or price will be dealt with as a variation in accordance with the applicable contract and these Terms.
5. Customer acceptance
A project is not confirmed until:
- the written quotation or contract is accepted;
- any required deposit or payment is made;
- any required statutory documents, certificates or insurance documents are issued where applicable;
- access and scheduling are agreed.
For residential building work in NSW, the form of contract and required documents will depend on the value and nature of the works.
6. Deposits and payments
Payment terms will be set out in the applicable quotation, invoice, contract or payment schedule.
Deposits and progress payments for regulated residential building work must comply with applicable NSW laws and the signed contract.
Where Roofing Goats is the contracting party, payments for the contracted works are payable to Roofing Goats unless otherwise stated in writing.
Failure to make a payment when due may result in suspension of works to the extent permitted by the contract and applicable law.
7. Home Building Compensation Fund insurance
Where Home Building Compensation Fund insurance is legally required for the contracted residential building work, Roofing Goats will arrange the required cover and provide the applicable certificate in accordance with NSW law.
Where HBCF insurance is required, the relevant certificate must be issued before Roofing Goats takes payment or commences the insured work, as required by law.
Any HBCF cover is subject to the terms, limits, eligibility requirements and operation of the applicable statutory scheme.
8. Statutory warranties
Residential building work in NSW is subject to statutory warranties where the Home Building Act 1989 (NSW) applies.
These statutory warranties apply independently of any separate workmanship warranty stated in a Roofing Goats quotation or contract and cannot be excluded by these Terms.
Nothing in these Terms limits any rights or remedies the customer may have under the Home Building Act 1989 (NSW), Australian Consumer Law or other applicable legislation.

Any work outside the agreed written scope is a variation.
Variations may arise due to customer request, hidden site conditions, safety requirements, compliance requirements, weather damage, defective existing work or other matters affecting the contracted works.
Variations must be agreed in writing, including the additional or reduced price and scope, before the varied work proceeds, except where urgent work is reasonably required to make the site safe or prevent immediate damage.
12. Weather and scheduling
Roofing works are weather-dependent.
Roofing Goats may reschedule works due to rain, wind, storms, unsafe conditions, supplier delays, access issues, illness, labour availability or other events outside its reasonable control.
Roofing Goats is not responsible for reasonable delays caused by matters outside its reasonable control, subject to any rights the customer has under applicable law.
13. Materials and product availability
Material colours, profiles, finishes, availability and lead times may vary depending on supplier stock and manufacturer production.
Colour samples, photographs and digital mock-ups are indicative only and may vary from the final installed product due to lighting, screen settings, batch differences and site conditions.
Substitute materials may only be used where suitable for the project and agreed with the customer where the substitution materially changes the agreed specification.
14. Existing roof condition and hidden conditions
The customer acknowledges that roof and building issues may not be fully visible before work commences.
Additional issues may become apparent after removing tiles, sheets, flashings, gutters, ridge capping, battens, sarking, insulation or other materials.
Roofing Goats is not responsible for pre-existing defects, concealed damage, structural movement, pest damage, asbestos, non-compliant prior works or other conditions that were not caused by Roofing Goats.
Where additional work is required because of a hidden or pre-existing condition, that work may be treated as a variation.
15. Safety and site control
Roofing Goats will manage the contracted works and site activities within its control in accordance with applicable safety requirements.
Roofing Goats may establish exclusion zones, access restrictions and other site controls for safety.
The customer, occupants and visitors must not enter work areas, climb ladders, access scaffolding, interfere with equipment or direct workers in a manner that creates a safety risk.
Employees, subcontractors and specialist trades engaged for the project must comply with applicable safety requirements relevant to their work.
16. Defects and completion
The customer must notify Roofing Goats of any alleged defect or concern as soon as reasonably possible.
Roofing Goats must be given a reasonable opportunity to inspect and, where responsibility is established, rectify any valid defect before the customer engages another contractor to carry out rectification or seeks reimbursement, except where urgent action is reasonably required to prevent injury or further property damage.
Minor colour variation, oil canning, expansion and contraction noises, visible fixings where appropriate, manufacturer tolerances and reasonable trade tolerances are not defects unless they breach the applicable contract, standards, manufacturer requirements or law.
Completion will be determined in accordance with the applicable contract and relevant law.
17. Warranties
Manufacturer warranties apply to the relevant materials and are subject to the manufacturer's terms, conditions, exclusions, installation requirements, environmental conditions and maintenance requirements.
The workmanship warranty applying to a project is the workmanship warranty expressly stated in the applicable quotation or building contract.
Where Goat Home Services Pty Ltd trading as Roofing Goats is the contracting party, Roofing Goats is responsible for the workmanship warranty stated in that quotation or contract.
Any workmanship warranty provided by Roofing Goats is in addition to, and does not limit, any statutory warranty or other right that cannot lawfully be excluded.
18. Maintenance
The customer is responsible for reasonable ongoing roof maintenance after completion, including gutter cleaning, removal of debris, checking stormwater flow, trimming overhanging trees, monitoring sealants and flashings, and arranging inspections where appropriate.
A manufacturer or contractual warranty may be affected where damage or failure is caused or materially contributed to by lack of required maintenance, misuse, third-party work, storm damage, structural movement or another excluded cause, subject to applicable law.
19. Limitation of liability
To the maximum extent permitted by law, Roofing Goats is not responsible for loss or damage to the extent caused by:
- pre-existing defects or concealed conditions;
- structural movement not caused by the contracted works;
- asbestos or hazardous materials not included in the agreed scope;
- customer, occupant or third-party interference;
- work carried out by third parties outside Roofing Goats' contracted scope;
- failure to carry out required maintenance;
- misuse, neglect, accidental damage or unauthorised modification;
- severe weather, natural events or other events outside Roofing Goats' reasonable control, except to the extent Roofing Goats is legally responsible for the resulting loss.
Nothing in these Terms excludes, restricts or modifies any liability, statutory warranty, consumer guarantee or other right that cannot legally be excluded, restricted or modified under the Home Building Act 1989 (NSW), Australian Consumer Law or other applicable legislation.
20. Employees, subcontractors and specialist contractors
Roofing Goats may engage employees, subcontractors, specialist contractors, consultants and suppliers to perform or assist with the contracted works.
Where a licence or specialist qualification is legally required for particular work, Roofing Goats will arrange for that work to be performed by a person or entity holding the required licence or qualification.
Where Roofing Goats is the contracting party, the use of employees or subcontractors does not by itself transfer Roofing Goats' contractual obligations to the customer.
21. Photos, videos and marketing
The customer permits Roofing Goats to take and use photos and videos of the roof, exterior property and completed works for quoting, quality control, training, marketing, social media, website, advertising and portfolio purposes.

Cancellation terms will be set out in the applicable quotation, contract or invoice and remain subject to any rights the customer has under applicable law.
Where permitted by the applicable contract and law, the customer may be liable for reasonable costs already incurred in connection with the project, including site inspections, administrative work, materials ordered, custom materials, supplier restocking fees, contractor booking costs, permits, engineering or other project-specific costs.
24. Disputes
If a dispute arises, the customer must first notify Roofing Goats in writing and provide reasonable details of the issue.
The parties agree to attempt to resolve the dispute in good faith before commencing formal proceedings, except where urgent action is required.
This does not limit any rights the customer may have to contact NSW Fair Trading, Building Commission NSW, NCAT, or another relevant authority.
25. Governing law
These Terms are governed by the laws of New South Wales, Australia.
